Ramdeb Sharma was a resident of Darjeeling and a follower of Congress. On 13 August 1942, he went about in the Chowk Bazar, Darjeeling, and its adjoining places, carrying a Congress flag in hand and shouting slogans, viz, "Mahatma Gandhi ki Jai", "Jawahar Lal Nehru ki Jai", Bande Matram", "Abul Kalam Azad ki Jai", "Hindustan Azad Rahey", "Hindustan Hindustanee ki hai, Angrezon ki Nhi", "Hindustan se Angrejon ko Nikalo". He attracted a crowd of about 40 to 50 men who followed him and heard his slogans. An ASI of Sadar Police station arrested him. The 1st class Magistrate of Darjeeling Mr. K. Ray in his judgment said:-" I do not think he deserves more than is due to him. He appears to have only imitated his local Congress president who did the same thing about the same time on that day. He is a mere follower of his leaders". Accordingly, Ramdeb Sharma was convicted under rule 38(5) of the Defence of India Rule and sentenced to rigorous imprisonment for six months and to pay a fine of Rs 10/- in default to suffer rigorous imprisonment of one month more.
